• • <br /> Letter to Bryce Romig -3- April 20 1997 <br /> b) Pipeline alignments and associated roads or trails, for example, <br /> the pipeline alignments that run from Robinson Lake up to Climax <br /> Camp. It is true that alignments of buried pipelines that have <br /> been adequately revegetated would not fit the definition of <br /> affected land, however, if these alignments are not included as <br /> affected land, CMC may be required to amend the permit in the <br /> future if the pipelines need to be excavated for replacement or <br /> repair. <br /> c) All underground mine openings and all boreholes. This would <br /> include, for example, the vent raise (s) and associated roads or <br /> trails located between the Storke Yard and Ceresco Ridge, and <br /> would also include, for example, the ground water monitoring wells <br /> below 5-Dam. <br /> d) The access roads that enter the Storke Yard at its southwest <br /> extremity. <br /> e) Number 4-Dam. This facility must remain within the area of <br /> affected lands until such time that the Division has made a <br /> finding that its beneficial post-mining land use has been <br /> achieved. Such a finding would be processed as a surety reduction <br /> as described in the Rules . <br /> f) Various roads trails on the site, for example, those roads located <br /> east of Mayflower Pond and 3-Dam. Roads and trails can only be <br /> excluded from the area of affected land if they were constructed <br /> for purposes unrelated to the mining operation and have not/will <br /> not be substantially upgraded to support the mining operation. <br /> 4 . It stated in Section 3 . 2 of the amendment (AM-003) application <br /> that much of the new acreage to be included into the area of affected <br /> lands will never be disturbed. In Section 3 .4 of the amendment (AM- <br /> 003) application CMC proposes to bond this added affected land on a <br /> generalized cost per acre basis . This bonding strategy is a <br /> conservative approach, and is acceptable to the Division. As further <br /> stated in Section 3 .4 , any disturbances in the added area of affected <br /> lands would probably be small, variable, and ancillary. Such <br /> disturbances within the added area of affected land would not require <br /> any additional permitting with the Division except, depending on the <br /> nature of the disturbance, a description in the annual reclamation <br /> report . The Division cannot, however, grant CMC unrestricted authority <br /> to create disturbances in the added acreage. Significant disturbances, <br /> such as the borrow pit CMC is considering to provide material for the <br /> capping of 3-Dam, would have to be incorporated into the mine plan <br /> through the appropriate revision process . <br /> 5 . The cost factors input to the summary table included in Section <br /> 3 .4 of the amendment (AM-003) application are acceptable to the <br /> Division at this time, with the exception that section 34-32- <br />
