Romer April 20, 1997 /— Governor James S.Lochhead Mr. Bryce Romig Executive Director Climax Molybdenum Company ✓ Michael B.Long Climax Mine Division Director Climax, CO 80429 / RE: Adequacy of the Amendment Application, Climax Molybdenum Company, Climax Mine, Amendment AM-003, Permit No. M-77-493Z/ Dear Mr. Romig: The Division of Minerals and Geology (Division) has completed a review of the above referenced amendment application, and has determined that Climax Molybdenum Company (CMC) must address the following issues in order for the application to meet the minimum requirements of the Colorado Mined Land Reclamation Act (Act) and the Rules and Regulations of the Mined Land Reclamation Board (Rules) . 1 . It appears that there is a conflict between the presently permitted acreage of affected land and the acreages discussed in the amendment (AM-003) application. It is stated in Section 1 . 0 of the amendment (AM-003) application that 3467 acres of affected land are presently permitted. It is stated in Section 2 . 0 of the amendment (AM- 003) application that 3475 acres presently are included in the permit as affected land. At the time of approval of permit amendment AM-002 in 1989, the permit specified 3372 acres of affected land. Although the presently permitted acreage of affected land is not particularly important, in that amendment AM-003 will revise this acreage, it should be clarified that the presently permitted acreage of affected land is the 3372 acres permitted through the approval of amendment AM-002 . If CMC possesses documentation that the presently permitted acreage of affected land is some amount other than 3372 acres, please provide copies of that documentation to the Division. 2 . It is stated in appendix (exhibit) A to the amendment (AM-003) application that the definitive legal description for the Climax Mine site is located in appendix A to the original (1977) permit . The legal description contained in the original (1977) permit encompasses 9946 . 59 acres . The legal description for the Climax Mine site was modified through approval of permit amendment AM-001 in 1980 to encompass 11, 601 . 41 acres. It is stated in the amendment AM-003 application that the CMC private land block at the Climax Mine now includes approximately 14, 000 acres, and this private land block is outlined on
