It appears that there is a conflict between the presently <br /> permitted acreage of affected land and the acreages discussed in the <br /> amendment (AM-003) application. It is stated in Section 1 . 0 of the <br /> amendment (AM-003) application that 3467 acres of affected land are <br /> presently permitted. It is stated in Section 2 . 0 of the amendment (AM- <br /> 003) application that 3475 acres presently are included in the permit <br /> as affected land. At the time of approval of permit amendment AM-002 <br /> in 1989, the permit specified 3372 acres of affected land. Although <br /> the presently permitted acreage of affected land is not particularly <br /> important, in that amendment AM-003 will revise this acreage, it should <br /> be clarified that the presently permitted acreage of affected land is <br /> the 3372 acres permitted through the approval of amendment AM-002 . If <br /> CMC possesses documentation that the presently permitted acreage of <br /> affected land is some amount other than 3372 acres, please provide <br /> copies of that documentation to the Division. <br /> 2 . It is stated in appendix (exhibit) A to the amendment (AM-003) <br /> application that the definitive legal description for the Climax Mine <br /> site is located in appendix A to the original (1977) permit . The legal <br /> description contained in the original (1977) permit encompasses 9946 . 59 <br /> acres . The legal description for the Climax Mine site was modified <br /> through approval of permit amendment AM-001 in 1980 to encompass <br /> 11, 601 . 41 acres. It is stated in the amendment AM-003 application that <br /> the CMC private land block at the Climax Mine now includes <br /> approximately 14, 000 acres, and this private land block is outlined on <br />
