Dear Mr. D r e .
As per our cussions during the tour and inspection of
Climax on August 1 , I am enclosing for the Climax file
copies of the pertinent public notification documents . As
you can see , we posted copies of the amendment and public
notice in Eagle , Lake , and Park Counties as well as Summit
County . It is our opinion that we have satisfied the
requirements of Rule 2. 2. 2 regarding public notification.
In addition to the above , this letter also will serve as
an agreement to waive the August date for Board considera-
tion. September or October is acceptable to Climax for
consideration of the amendment by the Board . At present,
the status of the amendment in no way impairs our ability
to operate and conduct the various reclamation operations
which were reviewed during your visit .
I also am including the "Tailing Pond Area Flood Control
Costs" information that inadvertently was omitted from
Appendix E of the amendment . I 'm not certain how that
occurred , but it does not effect the costs and information
detailed in Appendix D - the comprehensive data sheet .
Please let me know if I can be of further assistance. For
your information , I will be at the site on August 21 and
22 looking at vegetation plots and working with the
aquatics survey team.
