Boxl91 Division Director <br />Natural Resource Trustee <br />Victor, CO 80860-0191 <br />Re: Cresson Project, Technical Revision Approval, Permit No. M-1980-244, Revision No. TR-52 <br />Dear Mr.Goodrich: <br />On November 7, 2008 the Division of Reclamation, Mining and Safety approved the Technical Revision application <br />submitted to the Division on November 4, 2008, addressing the following: <br />Phase IVC Perimeter Liner Extension. <br />The terms of the Technical Revision No. 52 approved by the Division are hereby incorporated into Permit No. M-1980- <br />244. <br />The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M-1980-244 <br />remain in full force and effect. <br />1) Solution application in the Phase IVC area will be in phases. Initially only 400 gpm will be applied to the pad. <br />CC&V will monitor the flow for 7 days after initial application. If the ditch is functioning as designed, then full <br />solution application can commence and observed for the next 14 days, with frequency of monitoring the area to <br />remain at the current level of every 6 hours. If the pad is operating as designed after the 14`b day, the frequency of <br />monitoring will revert back to shift change inspections. <br />2) If ANY solution is observed or reported outside of the lined area, DRMS will send a reason to believe a <br />violation exists letter to CC&V and bring the matter before the MLRD BOARD. <br />No additional warranty is required for this technical revision, because the lined perimeter ditch reclamation is already <br />covered by the Phase IV pad reclamation warranty. <br />If you have any questions, please contact me at (303) 866-3567, x8129. <br />Sincerely, <br />Berhan Keffelew <br />Environmental Protection Specialist <br />cc: Tony Waldron, DRMS <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
