Box 670 Natural Resource Trustee <br />Hayden, CO 81639 <br />RE: Yoast Mine (Permit No. C-1994-082) <br />Technical Revision No. 38 (TR-38) <br />Pond 012 Slide Remediation Plan <br />Preliminary Adequacy Review <br />Dear Mr. Karo: <br />The Division has completed a preliminary adequacy review of the TR-38 application. The application <br />was submitted in response to NOV CV-2008-001, Abatement Item No. 2. The revision consisted of a <br />brief cover letter and a consultant's report, to be inserted in Permit Attachment 12-12B, "Pond 012 <br />Landslide Repair Plan". The cover letter explained that SCC had retained the services of a geotechnical <br />consulting firm, Northwest Colorado Consultants, Inc. (NWCC), and that NWCC had performed <br />preliminary investigations. The letter summarized the preliminary investigation and evaluation work <br />performed by NWCC, noted that additional monitoring and evaluations would need to be conducted <br />through the 2009 spring runoff season, and stated that "follow-up recommendations and plans will be <br />submitted once the remaining evaluations and assessments have been completed". The NWCC report <br />presented the results of initial field and laboratory investigations, provided recommendations concerning <br />the need for further monitoring, and presented preliminary stabilization/reconstruction <br />recommendations. <br />The Division has identified a number of concerns which will require clarification or submittal of <br />additional details and commitments. These adequacy concerns are listed in the enclosure. Please review <br />the enclosed concerns and provide a substantive response by December 5, 2008.
