III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete bond release inspection of the exploration drill sites for the 1994-1996 Coal <br /> Exploration Program conducted by Jason Musick of the Colorado Division of, Reclamation, Mining, <br /> and Safety (Division) on 08 and 09 October 2008. Scott Cowman and Joe Shoemaker of Peabody <br /> Mining accompanied the inspection. The weather was clear and sunny during the inspection. The <br /> ground was dry. <br /> The sites inspected included 7 remaining exploration holes drilled under NOI X-1994-214-00 which <br /> had not previously been inspected during a bond release inspection conducted on 8/26/2008. Holes <br /> 95013, 95012, and 95014 were not inspected due to inability to access the private property. <br /> The boreholes were abandoned and reclaimed in compliance with rule 4.07.3 by refilling them up to 10 <br /> feet from the surface. Cement was used to fill the hole up to 3 feet from the surface and the <br /> remainder filled with drill cuttings. The holes were marked by a t-post. Abandonment reports dated 14 <br /> August 2008 were provided to the DRMS for each hole. <br /> Each abandoned exploration drill site was located utilizing a Trimble GeoXT GPS unit with final drill <br /> site coordinates provided in the NOI permit. The results of the inspection, including example <br /> photographs of a portion of the 9 holes is provided below. <br /> All roads and pads were reclaimed. All 7 sites appeared to be well vegetated, with some sites <br /> exhibiting more vegetation than others. Some sites were located in existing wheat fields, however all <br /> sites appeared to be well vegetated and showed no signs of erosion, damage, evidence of roads, or <br /> any other problems. During the inspection there was no evidence that the drilling had occurred with <br /> the exception of the t-post at each location. <br /> Based on this inspection, it is determined that all 7 of the exploration holes inspected were properly <br /> abandoned and the drill sites were adequately reclaimed. All reclaimed exploration drill sites remain <br /> stable. <br /> Hole 94007 in location noted on abandonment Hole 94008 in approved location. Good <br /> report. No disturbance noted, no evidence vegetation cover, no evidence of damage or <br /> of drill pad noted. Drill site noted. <br />
