III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Hydrologic Balance <br /> Discussion on Small Area Exemption (SAE) and Alternative Sediment Control (ASC) issues - Upon <br /> successful Phase II bond release (SL-11) for the various parcels which ultimately drain to Pond <br /> 007, the only remaining potential contributors of runoff to the pond will be the office and shop <br /> area, and "Mt. Nucla". RG and HA discussed various approaches to take regarding these areas <br /> (and the gravel pad immediately west of Pond 007). WFC may be able to demonstrate that no <br /> runoff from these areas will be directed to Pond 007. <br /> Pond 007-The pond was not full, and no discharge was occurring at the time of the inspection. <br /> The V-notch weir (Figure 2) and associated discharge structures, visible due to the lowered <br /> water level, appeared to be in good condition. The CCC Ditch had been turned off on 04- <br /> October; there was no longer any inflow of irrigation water to the pond. <br /> Pond 008 - The pond was not full, and no discharge has occurred in several months. Two <br /> separate HDPE pipelines are still in place atop the western and southern perimeter of the <br /> impoundment (Figure 3). RG informed us that the larger (6") pipeline is no longer in use; it <br /> formerly carried water from pumping of the mine to Pond 007. The smaller (4") line carries water <br /> that WFC provides to Mr. Burbridge. <br /> Pond 009-The pond was completely dry at the time of the inspection. RG stated that this pond <br /> has never discharged. A temporary diversion ditch along the base of the hill to the south directs <br /> flow to the pond at the far SW corner. <br /> Pond 011 -The pond was discharging at approximately 350 gpm via a 12" Parshall Flume (Figure <br /> 4). Some vegetation is slowly beginning to appear on the pond slopes, which were seeded <br /> early this year. <br /> Pond 012 - Some water was standing in the western end of the pond (Figure 5), but the water <br /> surface was still well below the elevation of the discharge structure. <br /> Pond 013-Scattered puddles of water were observed on the pond bottom (Figure 6). It was not <br /> apparent whether the source of the water was surface runoff, or whether the pond excavation <br /> intercepts the phreatic surface of Tuttle Draw. <br /> Pond 014-This pond, visible from the BB Road Detour, was dry. It lies on property owned by Dirk <br /> Richards. WFC is currently in negotiations with Mr. Richards regarding the Detour, the fence, the <br /> pond, the head structure ("Box I") for the CCC Ditch, and the easement for the buried ditch <br /> pipeline. <br /> Support Facilities <br /> The shop and office area was neat and well-kept. There were no observed oil spills or potential <br /> hazards. WFC has made arrangements with a licensed contractor who periodically disposes of <br /> the empty oil drums. <br /> New Horizon Mine C-1981-008 15 & 16-Oct-2008 <br /> -2- <br />
