III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the operator <br /> during the field inspection. The weather was cool,dry and a little windy. <br /> Roads <br /> The main paved haul road was in good condition.The guard rail was up. The east entrance graveled road was <br /> also in good condition. The dirt light use road along the railroad tracks was dry and passable. <br /> Signs and Markers <br /> Mine identification signs were up at the main entrance,east entrance and along the road next to the railroad <br /> tracks. The required information was on each sign. <br /> Topsoil <br /> The east topsoil stockpile had a good vegetative cover. The collection ditch and the diversion ditch were well <br /> vegetated and the berm between the two ditches was in place. The topsoil stockpile signs were up. <br /> The west topsoil stockpile had a good vegetative cover as well.Topsoil signs were also up on this stockpile. The <br /> diversion ditch and berm were in place. <br /> H drology <br /> The main sediment pond on the east side of the facilities bench was dry. The pond embankment and pond <br /> inslopes appeared to be stable. The gate on the primary discharge pipe was closed.The emergency spillway was <br /> well vegetated.1 fie west side dugout pond was also dry. l tie single channel spillway was tunctional. <br /> The silt fence and straw bales along the railroad track small area exemption were in place.Mine site ditches and <br /> culverts were well maintained. <br /> Facilities <br /> There were coal haul trucks unloading and rail cars being loaded during the inspection.The crushing and <br /> screening operations were also in progress.In spite of all of this activity,there were no indications of fugitive <br /> dust going offsite.There was a black discoloration on the highway at the entrance to the loadout but this did not <br /> appear to be a problem. <br /> No problems were noted at the material storage area, loadout office, substation facilities bench and railcar <br /> loading facilities. The berm was up on the outside of the facilities bench. There were no leaks at the fuel facility. <br /> c:/word/terror/insp 1008 <br />
