III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the <br /> operator during the field inspection or records check. The weather was cool and dry. Minrec has applied for a <br /> Phase II and III bond release for the entire site. <br /> Roads <br /> The road up Hubbard Creek canyon was dry and in good condition.The light use road leading across Hubbard <br /> Creek and to pond 5 also was dry and passable. <br /> Signs and Markers <br /> The mine identification sign was on the front gate and contained the required information. The"records <br /> location" sign also was on the front gate. The front gate was closed and locked. Surface disturbance markers <br /> were up around the disturbed area. <br /> Hydrology <br /> The diversion ditch on the upper terrace was in place and was well vegetated. The collection ditch at the bottom <br /> of the mine slope had sufficient capacity. The culvert in Hubbard Creek at the mine entrance was clear of debris. <br /> Reclamation <br /> The operator has reclaimed pond 4 and pond 5. The pond embankments were pushed into the ponds and the <br /> discharge pipes were removed. The newly disturbed areas were seeded. However, silt fence needs to be installed <br /> at the downgradient ends for sediment control. The operator has also removed the long 18 inch diameter black <br /> plastic culvert that brought runoff down from the upper mine terrace. The culvert sections have been <br /> temporarily stored on the reclaimed coal stockpile area.The disturbance for this operation was very minimal. <br /> The portions of the three underdrain pipes that had been protruding from the ground at the base of the reclaimed <br /> slope were cut off and the pipe outlets were covered with rocks. <br /> The reclaimed mine bench slopes appeared to be stable, with no evidence of slope instability or erosional <br /> gullies. The upland diversion ditch at the reclaimed coal stockpile area was well vegetated. <br /> Noxious Weeds <br /> There are still several knapweed plants just north of the reclaimed pond 4 and in the middle of the reclaimed <br /> coal stockpile area..These need to be taken care of very soon. <br /> Records <br /> The mine records are located in the Delta County Clerk and Recorder's office in Delta.
