M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator during <br /> the field inspection,although Ron Hanna,the water sampler for the Bear Coal Company,was performing water sampling <br /> during the inspection.Bill Bear represented the operator during the records check. <br /> Facilities <br /> The operator has a dumpster on site and has filled it with debris from the demolished and burned mine office.Also,the <br /> concrete foundation of the former mine office has been broken up. The concrete pad,however,still needs to be broken up. <br /> The entrance gate to the mine site was open. <br /> Signs and Markers <br /> The mine ID sign and post are on the ground at the top of the hill and need to be put back up.The surface disturbance <br /> markers were up around the disturbed area.The"no trespassing"sign was up on the entrance gate. <br /> Roads <br /> The paved haul road was passable.The bridge was in good condition. <br /> Hydrology <br /> The hillside spring was flowing into the channel and culvert that take it to the hillside spring water treatment pond.A little <br /> spring water was not entering the channel and was flowing toward the mine office area.The quantity was small and did not <br /> appear to present a problem. <br /> The water level in the hillside spring water treatment pond was within 8 inches of the horizontal pipe. The pond was <br /> d1Scharg:n.D at about in to 15 gpm The Xing o—nffe;^ nInr,which hq been Shun in the poet t^be i <br /> compliance with water quality standards.The sediment pond was dry.The pond embankment was stable.Pond discharge <br /> structures were operational with the gated primary pipe valve in the closed position. <br /> The collection ditch that enters the sediment pond had sufficient capacity.The river berm also had enough height to protect <br /> the facilities area.The caps were on both of the alluvial wells.The road culvert at the entrance gate had enough capacity. <br /> Noxious Weeds <br /> The operator has cut down and treated the remaining roots of the tamarisk that had been growing along the fence near the <br /> entrance gate.The tamarisk along the water's edge of the hillside treatment pond and at the hillside spring area still needs <br /> to be.rut dawn and treated. <br /> Reclamation <br /> The reclaimed haul road and reclaimed fan area appeared to be stable.The reclaimed portals on the west side continue to <br /> show instability.The original unstable area has been covered up with soil and rock from the above slope.The new unstable <br /> area that is 50 to 75 feet to the east of the original unstable area is showing more signs of cracks and holes,as well as the <br /> odor of smoldering coal. <br /> Records <br /> The required mine records were at the Bowie No.2 Mine office,as shown on the attached records checklist. <br /> c:/word/bear3/insp 1008 <br />
