Talvitie <br />Environmental Protection Specialist <br />DRMS Durango Field Office- Coal Program <br />Thank you for your email dated 10/20/2008 in which you have indicated that the TR-58 application package does <br />not include the property west of 2700 Road. <br />The legal description of the Lloyd property is : West one-half ( 1/2 ) of the southeast one-fourth ( 1/4 ) of <br />Section thirty-six, Township Forty-seven (47) North, Range (16) West, N.M.P.M. In the Public Notice by <br />Western Fuels-Colorado, published in the San Miguel Basin Forum newspaper on Sept. 25 and October 2, 9, and <br />16, Section 36. T 47 N, R 16 W is included in the Technical Revision that is being requested. <br />Therefore we are submitting our comments for TR-58. Please consider our concerns when they apply to our <br />property, whether it is now or later. <br />1. We request that no changes will be made on the requirement to backfill with no rocks near the surface, <br />then grade and replace topsoil per the original permit requirements. <br />2. We request that no change to dry land pasture will be made in the portion of our property that was designated <br />as irrigated pasture in the Post mining Vegetation/ Land use Map, New Horizon 2 Study Area. <br />3. In a letter dated October 27, 2004, Mr. R. Lance Wade, Western Fuel Mine Manager, indicated that they will <br />endeavor to recontour the property to maximize our ability to flood irrigate the property after it is returned to us. <br />We had requested this in a letter to him on 10/11/2004. We do not want to be required to use a sprinkler for <br />irrigation. <br />4. We request an opportunity to comment if the vegetation production standards for our property need to be <br />modified from the original requirements. <br />Thank you for considering our request. <br />Sincerely, <br />Harry C.
