(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-t 9R5-099 <br />INSPECTION DATE: _ Ai jqi isf 9A. 9()0$ INSPECTOR=S INITIALS: _D62 <br />OBSERVATIONS <br />This inspection was conducted by David Bird and Tony Waldron of DRMS to assess the site in relation to the <br />amount of financial warranty that should be required. Also present during the inspection was Mark Heifner, <br />consultant to Penn Mountain Mining. The site is located approximately 14 miles northwest of Fairplay in Park <br />County. Gold is the commodity of interest at this mine. <br />Due to access difficulties at this high-elevation site, the Division had granted the Operator an extension from a <br />notice of Financial Warranty increase dated June 8, 2008. After the current assessment of site conditions, the <br />Division representatives and the Operator's consultant all agreed that the financial warranty, currently set at <br />$128,461, accurately reflects the current costs of reclamation. Additionally, unless mining activity resumes, the <br />Operator will be required to file for Temporary Cessation no later than 90 days after the Financial Warranty is <br />brought up to the required amount. <br />The most pressing area of concern is the leaking containers of petroleum products and drilling additives that are <br />located at various locations around the site. These are a threat to the hydrologic balance via ground water <br />contamination and must be remedied as soon as possible.
