An old headframe, which was once the highest point to the east, is now dwarfed <br />by huge slag mountains. <br />4. We do not want a "scar" on our mountains such as the eyesore that continues to <br />be a blight on the view in Colorado Springs. <br />5. The proposed project will reduce property values dramatically. <br />6. There will be noise, lights, (and) traffic 24/7 (24 hours per day/7 days per week). <br />IV. WITNESSES AND EXHIBITS <br />The Applicant and the Objectors exchanged Lists of Witnesses and Exhibits at the Pre-hearing <br />Conference or soon thereafter. All items admitted by the Board as evidence at the Formal Public <br />Hearing will become part of the administrative record. Upon request, a party may recover any <br />evidence introduced by that party, if no action for judicial review is commenced within thirty <br />(30) days of the date that agency action in this matter becomes effective. <br />V. PROCEDURE <br />The Division, the Parties, and any members of the public attending the Formal Public Hearing <br />shall make presentations in the order prescribed below. The time limits set forth below are <br />maximum and shall be strictly enforced. The Board has the right to limit any redundant or <br />irrelevant testimony. As noted below, all parties will be afforded an opportunity to conduct <br />cross-examination of any witnesses that testify during the presentation. <br />Board's Consideration and Adoption of the Proposed Pre-Hearing Order: <br />The Pre-Hearing Conference Officer shall have 5 minutes to present this Proposed Pre- <br />Hearing Order to the Board for adoption. The Board will hear any objections to the <br />Proposed Pre-Hearing Order at that time, and will make any necessary amendments prior <br />to adopting the Order. <br />2. Division's Introduction: <br />The Division shall have 10 minutes in which to present an overview of the application. <br />3. Applicant's Presentation: <br />The Applicant shall have 20 minutes in which to make a presentation to the Board. The <br />Applicant's witnesses may be cross-examined by the Objectors following their testimony. <br />8
