The problems should be corrected by the dates given, or they will become possible <br />violations. The possible violations should be corrected by the dates given to reduce their severity when <br />considered by the Mined Land Reclamation Board. The inspector noted on the previous page should be <br />notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />r)ATF <br />/ Problem Possible Violation: November <br /> The pit slopes are not set back 25 feet from the permit boundary line around the Scotts 28th, 2008 <br /> fence line. This is a problem at this time for failure to follow the approved mining plan. <br /> Pursuant to C.R.S. 34-32.5-112 (VI) <br />Type Ps <br />Topic MP <br />Corrective Action: <br />The pit slopes shall be backfilled and graded to create the 25 foot setback away from the <br />permit boundary the runs along the Scotts fence line. Please submit photographic <br />documentation and a written notice to the Division when this task has been completed. <br />4 Problem Possible Violation: 17 November <br />2•) The operator has not submitted the corrective action required from the November 20th, 14°h, 2008 <br /> 2008 inspection report. <br />Type Ps <br />Topic I ST <br />Corrective Action: <br />Provide the Division written evidence of agreement with the Scotts regarding operator- <br />chosen method for the Scotts ready access to an available water source on or before <br />November 14th, 2008. <br />5
