All required operations would take place <br />on BLM surface. <br />Since the adjacent private lands will be reclaimed more acreage is required to remain <br />unreclaimed for active operations and 9.3 acres of disturbance at one time is reasonable and <br />covered by previous environmental analysis. I approve the proposal to have up to 9.3 acres open <br />and unreclaimed at one time to accommodate for mining, processing and storage. <br />I do not approve construction of the safety berm along the eastern boundary of the project area. <br />In reviewing past correspondence it is apparent that unauthorized motorized use and vandalism <br />have occurred in the United gravel pit permit area. However, my staff sent United a letter dated <br />October 26, 2006 requesting the gate on the eastern boundary be replaced with permanent <br />fencing to prevent unauthorized access. To date this has not been completed and the wire gate <br />remains in place. My staff also sent United a letter dated November 18, 2004 and stipulation <br />number five required no soil material to be placed on any phases over the winter period. <br />In conclusion I approve the proposed mine plan modifications allowing up to 9.3 acres to be <br />disturbed at one time to accommodate for mining, processing and storage facilities. I deny the <br />request to construct the 8-10 foot tall topsoil safety berm along the eastern boundary and strongly <br />recommend replacing the wire gate with permanent fencing to prevent unauthorized access to the <br />permit area.
