Division Director <br />Nucla, Colorado 81424 Natural Resource Trustee <br />Re: Permit No. C-1981-008 - New Horizon Mine <br />TR-57 - Soil Resource Info, Soil Handling, and Prime Farmland <br />Second Adequacy Review <br />Dear Mr. Gubka: <br />Western Fuels-Colorado (WFC) submitted its application for TR-57 to Permit No. C-1981- <br />008 on 09 April 2008. On the 15th of May, the Division issued a Preliminary Adequacy <br />Review (PAR) of WFC's TR-57 application. The PAR included a list of 39 separate <br />comments, requesting additional information. In response to the PAR, WFC submitted a <br />second complete application package. This package, which included revised maps and <br />revised sections of text, was received by the Division on 04 August 2008. <br />The Division has completed its review of WFC's most recent TR-57 submittal, and has <br />evaluated its adequacy with respect to each of the items raised in the initial Adequacy <br />Review. The original itemized list follows, with the Division's original requests italicized, <br />and new comments in boldface type. <br />All items have been satisfactorily resolved, with the exception of 28, 30, 34 and 39. <br />Section 2.04.9 (Soil Resource Information text, tables, appendices, and maps) <br />1. The two maps included in the Section 2.04.9 submittal are not listed in the Table of <br />Contents. Please revise the Table of Contents to list Maps 2.04.9-1 and 2.04.9-2. <br />Item Resolved <br />2. In Table 2.04.9-1 (Procedures and Analytical Procedures Utilized for [Premine] <br />Topsoil Analysis), on page 2.04.9-11, it is indicated that physical characteristics of <br />each sampled profile were described and recorded. This information does not seem to <br />have been included in the Section 2.04.9 tables or attachments, and needs to be <br />provided to supplement the soil laboratory data.
