Introduction and Chronoloey of Review Process <br />This document presents the findings and decision of the Division of Reclamation, Mining and Safety <br />("DRMS") pertaining to a Request for Transfer of Coal Permit and Succession of Operators (the <br />"application"). The applicant, National King Coal, LLC, submitted the application to DRMS as a result of <br />changing the name of National King Coal, LLC to GCC Energy, LLC. <br />As summarized below, the application was submitted and reviewed pursuant to Rule 2.08.6 of the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />Action Date <br />National King Coal, LLC changes name to GCC Energy, LLC (referred to below as "GCC"). 10/22/07 <br />DRMS receives an application for Succession of Operators from GCC to reflect the change of <br />ownership. The application includes: the properly executed SO form, a proposed public <br />notice, and permit pages revised to show GCC as successor to National King Coal, LLC for 12/21/07 <br />federal employer W. no., mineral leases, rights-of-way, and various permits. Revised permit <br />pages also contain updated ownership/controller information. <br />DBMS notifies GCC by letter that the application will remain incomplete until a new bond 1/4/08 <br />and liability insurance certificate are submitted . <br />DRMS finds ownership/controller information in applicant violator (AVS) system matches <br />information submitted by applicant as of execution date of application. OSM 1/10/08 <br />recommendation: "Issue". <br />DRMS receives new liability insurance certificate and a rider having an effective date of <br /> <br />2/27/08 naming GCC as principal for bond no. 3/5/08 <br />DRMS notifies GCC by telephone that the SO application is complete and verifies there have 4/2/08 <br />been no changes in owners/controller information. <br />DRMS completes second AVS check. OSM recommendation: "Issue". 4/2/08 <br />DRMS issues the following proposed decision to approve SO-03. 4/2/08 <br />King I and II Mlnes Page 1 April 2, 2008 <br />SO-02
