Canany <br />Division Director <br />DATE: October 22,2008 Natural Resource Trustee <br />SUBJECT: Bowie No. 2 Mine, Permit No. C-96-083, Permit Revision No. 10 <br />I have reviewed Bowie Resources, LLC (BRL's) PR-10 responses to our 8th adequacy review letter <br />which was sent to BRL on October 2, 2008. BRL has now adequately addressed all of our <br />comments. We had previously accepted the text revisions and the new cross section/fence diagram <br />for the Lower Perched Water Zone (Map 11-1). My review of their response to our final comments <br />is given below in the same numbered paragraphs as our October 2 d letter. <br />2A. <br />1. We requested that the Upper Perched Water Zone also be shown in Cross-Section. BRL <br />updated the text on page 2.0428 to explain that it is not possible to predict a piezometric <br />surface over an extensive area for the Upper Perched Water Bearing Zone. Therefore BRL <br />does not provide a cross-section for the Upper Perched Water Zone as explained in their <br />response. I noted one typo in the third to last sentence of the first paragraph of page 2.04-28 <br />where "underling" should read "underlying". <br />2. BRL fully explains the significant elevation differences that I noted in my previous review <br />when comparing existing approved Map 11 to the proposed revised Map 11. I have no <br />further comments. <br />I believe that with these revisions to the PAP (discussing difficulty of deeper wells not <br />located along the Hubbard Creek drainage) and in combination with the USFS Paonia <br />Ranger District letter stating that it would be "highly unlikely" that BRL would be granted <br />access to drill a monitoring well along Hubbard Creek; it would be reasonable for the <br />Division to accept this as sufficient to satisfy Rule 2.04.7 and ultimately approve PR-10. <br />BRL has (to the best of their ability) satisfied the requirements of 2.04.7(4)(c). <br />Let me know if you have any questions regarding my review of BRL's latest responses. <br />C: Denver File <br />Sandy Brown <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
