Cell 1 area is considered sufficiently reclaimed in compliance with the approved permit as <br />determined by DRMS following submittal of a bond release application. Another meeting will be <br />required to clarify exactly what the reclamation standard for that area will be to avoid any future <br />misunderstandings. <br />3) The Town of Erie may submit a "reclamation only" standard 112 permit application to DRMS <br />for the Cell 1 area, and/or any other areas to be removed from the existing Turnpike permit for <br />which the Town of Erie will assume responsibility. If and when the Town of Erie's application is <br />approved by the Division, the areas in common within the Turnpike and Town of Erie permits <br />may then be removed from the Turnpike permit area, through an appropriate surety <br />reduction/release action. Please be aware that the Town of Erie's reclamation plan will have to <br />adequately address the final proposed post reclamation use of the land, and the full permit process <br />will be need to be adhered to. Another meeting will be required to clarify what on site activities <br />Asphalt Specialties will be allowed to conduct in the Cell 1 area during the interim period in <br />which the Division is reviewing the application submitted by the Town of Erie. In the event an <br />application is either not submitted by Erie, or not approved by the Division, the reclamation <br />liabilities under the permit currently held by Asphalt Specialties will remain in effect. <br />DRMS is not recommending any actions to be taken by the Town of Erie, and is only providing <br />this option in response to the permittee's indications that they may approach the Town with this <br />concept. <br />Please notify the Division of how Asphalt Specialties would like to proceed within 30 days of <br />receipt of this letter. If Asphalt Specialties has not selected one of the above options to proceed <br />and notified the Division of its choice at that time, the Division will schedule a full inspection of <br />the site to make a determination of current compliance status.
