The meeting was held pursuant to the state agency
consultation requirement of the State Register Act, C.R.S. 24-80.1-101 et al. Thank you
again for your time during the DRMS review period and I am pleased that we were able to
resolve the comments and concerns raised by SHPO in the comment letters. This letter will
confirm the resolutions we were able to reach, as well as explain the recommendations that
SHPO would like DRMS to incorporate into the permitting process.
In regard to the piece of the Cripple Creek National Historic Landmark District
[5TL.2] that is included within the affected area to be mined, you indicated that the voluntary
steps taken by CC&V to mitigate the visual impact the mine expansion will have on the
historic viewshed satisfactorily resolves SHPO's concerns. The Memorandum of
Understanding (MOU) entered into by CC&V and the City of Cripple Creek adequately
addresses the concerns raised by SHPO regarding mitigation of the visual impact to the
historic area and the restoration of the area to its approximate original contour or historic
configuration. In addition, SHPO understands that CC&V will commence mining in the
North Cresson view shed area no sooner than 2014. Therefore, the historic viewshed issues
have been resolved to SHPO's satisfaction.
