III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Eastside Mine conducted by Erica Crosby of DMG. No <br /> company representative was present during the inspection. The Eastside Mine is in reclamation only <br /> status. Weather conditions on site were overcast and raining. Ground conditions were muddy. <br /> Records Mine records were inspected at the Garfield County Courthouse. See attached records <br /> report for further detail. The following items need to be filed in the courthouse; <br /> * 1996 Annual Reclamation Report (ARR) <br /> * Renewal Permit <br /> * 1 st quarter 1997 NPDES Records <br /> * 1st quarter 1997 Pond Inspection Report <br /> Signs & Markers Mine ID sign was posted, and all information appeared accurate. On December 18, <br /> 1996, the Mined Land Reclamation Board promulgated revised Sections 4.30.1 and 4.30.2 to require <br /> that operators modify or supplement mine identification signs if an operation will be in temporary <br /> cessation for more than thirty days, or is in permanent cessation. Mine signs must now include the <br /> name, address, and telephone of the Division office where the mining and reclamation permit is filed. <br /> The operator needs to revise the mine ID sign or add a new sign with the information noted above. <br /> Roads The road leading into the Eastside Mine was muddy, but in good repair. The gate at the mine <br /> entrance was locked. Road ditches and culverts were in good repair. <br /> Hydrolo-gic Balance The sediment pond was dry and no recent mine discharge was noted. The <br /> pond embankment was well vegetated and stable. The permanent diversion ditch was in good repair. <br /> The operator should finish the lower portion of the drainage where it ties into the natural drainage this <br /> field season. The clean water diversion ditch was generally in good repair. As noted in the previous <br /> inspection report, some minor slumping of the diversion cut was noted on the upper portions of the <br /> ditch. It does not appear that the material in the ditch will reduce the capacity. The ditch cut should <br /> be visually monitored for future instability. The mine water pipe was not discharging, and no recent <br /> discharge was noted. <br /> Backfilling & Grading The backfilled and graded area appeared stable and there were no signs of <br /> erosion. The portal area appeared stable and no subsidence features were noted. <br /> Revegetation Vegetation was starting to emerge throughout the reclaimed area. The grasses could <br /> not be identified at this point in time. Some small shrubs were also noted. <br />
