III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> The site of the A Substation and the two locations on either side of the Colorado River where the <br /> overland conveyor tube/bridge structure had been removed and associated areas regraded were <br /> found to be stable and revegetated with no signs of erosion or other problems identified. See the <br /> attached Photograph Numbers 10 and 11 of the A Substation and the location where the overland <br /> conveyor tube/bridge structure has been removed,respectively. <br /> Reclamation Success <br /> The South Portal area has been reclaimed in accordance with the approved plan as set forth by <br /> PR-3 for the Steep Slope Variance from Approximate Original Contour to allow for retention of <br /> facilities and to support the alternative "Industrial or Commercial"postmining land use. All <br /> disturbed areas other than those described in this report for the Steep Slope Variance were <br /> returned to Approximate Original Contour. Slopes throughout the South Portal area are in <br /> agreement with approved post-mining contours as shown on Postmining Topography Map, <br /> Exhibit 6C. The entire South Portals reclaimed area for which bond release was requested is <br /> stable and in good condition. There were no signs of serious erosion or instability. Surface <br /> runoff control appears adequate. Sediment and drainage control structures were all functioning <br /> as intended and appeared to be properly maintained. Only minor problems were noted at two <br /> surface ditch locations including Ditch R-R' where some maintenance of the ditch will be <br /> occasionally required and Ditch E1-E1' where some ponding occurs in a flat section of the ditch. <br /> The facilities area and perimeter locations at the South Portal were well maintained and no <br /> significant problems were noted during this inspection. There are no areas identified as <br /> erosionally unstable that would be excluded from this Phase I bond release request. <br />
