III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Air Resource Protection <br /> A water truck was active on the site, loading its tank from the elevated water storage tank at <br /> Pond 011 and applying water to haul roads throughout the permit area. On this hot, dry day, <br /> keeping ahead of the dust was a challenge. <br /> Prime Farmland (Section 4.25) <br /> Topsoil stripped from the prime farmland area has been stockpiled to the east of the active <br /> mine, in separate piles based on the horizon from which it was removed. Topsoil stockpiles are <br /> larger and more plentiful than those observed in August (Figure 8). It appears that topsoil <br /> stripped from prime farmlands is being stockpiled on land owned by the same landowner, i.e. <br /> topsoil stripped from Morgan's land is being stockpiled on Morgan property to the east of the <br /> active pit area. The as-yet-unmined field in the southwest corner of the permit area was being <br /> irrigated with a sideroll system. The field appeared to have been mowed fairly recently. <br /> According to Mr. Gubka, WFC has given notice to the landowner (Morgan) that the company <br /> intends to take possession of the field. <br /> New Horizon Mine C-1981-008 30-Sep-2008 <br />
