6.4.8 Exhibit H Wild life information. <br />9) Has the operator agreed to implement comments from DOW (Division of Wildlife) (Carl Poch, <br />Laura Jeffrey, Jo Ann Harris) <br />DBMS Response: <br />CC&V was provided with the comments received from DOW and have agreed to implement all the <br />suggested comments. <br />Other Comments: <br />The Division received comments from The Colorado State Historical Society (SHPO) pursuant to the State <br />Register Act, C.R.S. 24-80.1-101 et al, regarding potential adverse impacts to the Cripple Creek National <br />Historic Landmark and historic structures. SHPO's comments have been forwarded to CC&V. Under the <br />consultation requirements of the State Register Act, DRMS met with SHPO representatives on August 31, <br />2008 at our offices. In addition, a site visit was conducted on September 26, 2008 with Mr. Dan Corson of <br />SHPO, and Mr. Jeff Fugate of the Attorney General's Office. A second meeting was held with SHPO <br />representatives on October 16, 2008. In short, SHPO has informed DRMS that CC&V has taken the <br />necessary and appropriate steps to mitigate the impact to the Cripple Creek Historic District landscape or <br />viewshed; therefore, the viewshed issues raised by SHPO's comment letter have been resolved to their <br />satisfaction. Additionally, SHPO has recommended that DBMS request that CC&V conduct proper <br />inventory and recordation of the various historic structures on site prior to relocation or demolition. <br />Specific to the Simms ore sorting house and associated/ adjacent structures, which are located inside the <br />national historic landmark boundary, SHPO has requested that the inventory and recordation follow the <br />procedures laid out in SHPO's Level 11 standards for historic resource documentation. The requests and <br />recommendations presented by SHPO to DRMS will be further explained in detail by separate <br />correspondence.
