The Division's <br />response to objection issues follows. References to the Rules are from Minerals Rules and Regulations of The <br />Colorado Mined Land Reclamation Board for Hard Rock Metal and Designated Operations <br />6.4.4 Exhibit D- Mining Plan <br />1) Blasting Damage to property and structures in Cripple Creek ( Carl Poch, Mr. & Mrs. Raymond and <br />Mr. Dan Baader, Mayor, Cripple Creek) <br />DBMS Response: <br />To date, CC&V has never exceeded the peak particle velocity of 0.5 inches per second set by the Division in <br />accordance with the Office of Surface Mining, Reclamation and Enforcement's Blasting Guidance Manual <br />and approved by the Mined Land Reclamation Board. <br />The Division has scrutinized the information submitted both within the amendment application and by the <br />commentors. The Division believes CC&V has adequately demonstrated past blast monitoring compliance <br />within the City of Victor through appropriate blasting, vibration, geotechnical, and structural analyses. <br />These analyses demonstrate that off-site areas will not be adversely impacted by placing seismograph <br />monitoring points as approved by the DRMS. In addition, in the Cripple Creek area that has not affected by <br />the past mining activities, CC&V will conduct a pre-blast survey of structures that could potentially be <br />affected. Pre-blast surveys will be conducted at all structures located within one-half mile of the proposed <br />blasting area unless persons in ownership or control deny access to the structures. Requests to conduct pre- <br />blast surveys will be sent to owners of record of these structures a minimum of 30 days prior to initiating <br />blasting with in one-half mile. CC&V will provide the plan to the DRMS for review and approval prior to <br />conducting the survey. CC&V has proposed to place one additional seismograph for monitoring of <br />potential impacts to structures in Cripple Creek. The location of the new seismograph will be established <br />prior to the MLRB's decision on Amendment # 9 and be at the closest structure to include the Molly <br />Kathleen underground mine. <br />2) Noise from Blasting (Carl Poch, Dan Baader and Joan Harris)
