RE: M-1999-120, Fort Lupton Sand and Gravel Mine, TR-03, Adequacy Review Response for <br />Technical Revision and Request for Extension of Decision Date until October 24, 2008 <br />Topsoiling - Average depth of topsoil replacement as per the approved reclamation plan will be 6 to 12 <br />inches. The distances from topsoil piles to final replacement will vary from phase to phase. The <br />estimated distance from temporary topsoil stockpiles to replacement is 1,000 feet on average. <br />Seeding - Two seed mixes approved for our permit and listed in our amendment application permit are <br />"Reclamation Seed Mix for Water's Edge" and the "Permanent Mix for Pit Edges and Other Disturbed <br />Areas." These mixes will be used on the "Acres to be topsoiled" shown in the table above - assume half <br />of the acres to be covered with one mix and half of the acres with the other mix (or their equivalents, as <br />availability demands). A copy of the seed mixes is attached for reference. <br />Earthmov!na - The pit walls will be sloped at 3:1 as per our permit. The estimated amount of backfill <br />material per phase is shown above. The estimated distance for moving the materials to final sloping is <br />1,000 feet on average. <br />Water Storage Volume and Discharge - Please keep the estimated volumes confidential. In your email, <br />you requested information on pit capacity (water storage volume) and distance to discharge for the <br />largest pit. As shown above, the largest phase is the Fort Lupton phase. The distance to discharge is <br />approximately 0-300 feet. We have a discharge point off the southeast corner of the Fort Lupton phase to <br />the South Platte River (approximately 300 feet), and a discharge point directly into the Lupton Bottom <br />Ditch, both of which have been approved for our CDPS discharge permit by the CDPHE-WQCD. <br />Final Grading <br />To answer the final grading question from the adequacy review letter, the final grading has not been <br />completed in either of the Fort Lupton phases or in the Golden phase. Much of the initial sloping and <br />grading has been done in these phases, but the final grading is not completed. <br />Ditch Reconstruction <br />We had forgotten that reclamation costs were added for mining and reconstructing the Lupton Bottom <br />Ditch in our original permit and subsequent bonding! Thank you for bringing this up in your letter and <br />email. Any bonding costs related to ditch reconstruction are no longer applicable. The ditch is in place, <br />will remain in place, and we will not line it with concrete. When we amended the original permit in 2005, <br />we included a new agreement with the Lupton Bottom Ditch company (dated September 24, 2004) in our <br />first adequacy review response. The new agreement no longer includes ditch reconstruction but it still <br />guarantees that L. G. Everist will repair any damage or compensate the ditch company for any damages <br />caused by our mining operations, as required by the Division. This change was approved as part of the <br />amendment approval.
