MINE ID # OR PROSPECTING ID #: U-9008-060- <br />INSPECTION DATE: 09/7'V08 INSPECTOR=S INITIALS: MAC <br />OBSERVATIONS <br />The inspection of the CLG Farms, LLC Pit was conducted by Michael Cunningham of DRMS, Tony Waldron of <br />DRMS, and Mr. Gebauer of CLG Farms, LLC. The CLG Farms, LLC Pit is located approximately 6 miles south and 3 <br />miles east of Akron, CO off of County Road FF. The permitted area encompasses 9.41 acres. <br />This was a pre-operation inspection conducted by DRMS prior to permit application approval. The site is <br />currently being used as rangeland; no cattle were present at the time of the inspection. Mr. Gebauer informed <br />the inspector that the entire permit area would be fenced off before mining begins. The corners of the permit <br />boundary were clearly delineated with wooden posts. The site has a well established stand of blue grama. <br />Surveyor Creek, which runs along the east side of the permit boundary, had recently flooded according to Mr. <br />Gebauer. There was standing water in the creek and a debris line could be seen approximately 25 feet above <br />the bank on the west side of the creek. The inspector recommended that Mr. Gebauer use the debris line to <br />delineate the flood elevation level for a ten year, 24 hour storm event. Mr. Gebauer was advised to leave a <br />berm in place along the debris line. <br />The inspector noted a discrepancy in the maps that were provided to the Division as part of the Application <br />Package. The maps show that there is an existing road leading from County Road FF to the north side of the <br />permit boundary. There is a two-track road that runs 1230 feet west from County Road FF. However, there is an <br />approximately 580 foot gap between the end of the two-track road and the north side of the permit boundary. <br />As such, the permit boundary will need to be revised to include the construction of a road that connects the <br />two-track road to north edge of the permit boundary. The inspector recommended that Mr. Gebauer change <br />the configuration of the permit boundary by moving the east boundary of the permit area from its current <br />location on the east bank of the Surveyor Creek, to the west side of Surveyor Creek along the debris line. The <br />acreage that was lost by moving the east permit boundary could then be used to connect the two-track road <br />to the north end of the permit boundary. The Operator should note that any improvement to the existing two- <br />track road would result in the need to increase the affected acreage to include this road. An improvement <br />would include installing culverts, widening, or paving the road.
