Talvitie <br />Environmental Protection Specialist <br />Division of Reclamation, Mining, & Safety <br />Department-of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Bowie No. 1 Mine (Permit No. C-1981-038) Technical Revision Application No. 50 (M-50); Two <br />Exploration Holes (CHS # 53383) <br />Dear Ms. Talvitie: <br />Thank you for your correspondence dated September 18, 2008 (received by our office on September <br />23, 2008; map of the proposed areas of new disturbance received by our office on October 8, 2008) <br />regarding the subject project. <br />Because the proposed mine plan revision involves Federal oversight, please note that it is the <br />responsibility of the Federal agency to comply with Section 106 of the National Historic <br />Preservation Act as set forth in 36 CFR 800 ("Protection of Historic Properties"). This includes the <br />identification of any historic properties (i.e. cultural resources which are eligible to be listed in the <br />National Register of Historic Places) within the area of potential effects and determining whether <br />the undertaking will have an effect upon such properties. The State Historic Preservation Office, <br />Native American tribes, representatives of local governments, and applicants for Federal permits, <br />licenses or other approval are entitled to consultative roles in this process. <br />A search of the Colorado Cultural Resource Inventory database indicates that two cultural resources <br />have been recorded within or near the proposed permit area. In 1977, site 5DT97 was recommended <br />as not eligible for the National Register of Historic Places (NRHP) based on a field assessment; in the <br />same year, a recommendation of needs data (potentially eligible) was made for site 5DT123 based on a <br />field assessment. Our files contain incomplete information for this area, as most of Colorado has not <br />yet been inventoried for cultural resources.
