Summary <br />The Review Process <br />Permit C-80-007 was issued on July 31, 1981 for an initial five-year term, and since then has <br />been renewed for five additional five-year terms. Twelve permit revisions have also been <br />approved since 1981. The review process for past permit renewals and permit revisions is <br />summarized in Appendix "B" at the end of this Findings document. <br />MCC submitted the application for PR-14 (methane drainage wells for longwall panels E-2 <br />through E-12) on August 14, 2008 and the Division found the application complete on August <br />18, 2008. The Division sent completeness notification letters to various agencies in accordance <br />with 2.07.3(3)(b). <br />The Division conducted a preliminary adequacy review of the PR-14 submittal, as summarized <br />in a memo to the PR-14 file dated September 18, 2007, and comments were submitted to the <br />applicant in a letter on that day. The adequacy letter requested that MCC submit a revised permit <br />page reflecting the planned submittal of bond in increments. The letter also explained that <br />DRMS was preparing a reclamation cost estimate for PR-14. All concerns in the September 18 <br />letter were resolved by MCC's responses submitted on October 9, 2008. <br />The Division asked MCC via phone on October 6, 2008 to submit updated ownership and <br />control information. MCC responded with updated permit pages sent via email on October 9, <br />2008. The Division asked the U.S. Forest Service via email on September 22, 2008 to verify that <br />two road segments proposed in PR-14 were outside the Roadless Area. The Forest Service <br />responded by email on September 23, 2008 saying the roads were outside the Roadless area and <br />the PR-14 map showing the roads needed to be updated. This email was forwarded to MCC <br />who submitted an updated map on October 9, 2008. The Forest Service indicated in a letter <br />dated October 9, 2008 that they had no further adequacy concerns regarding PR-14. <br />In addition to the comments from the Forest Service, the Division received a comment from the <br />State Historic Preservation Officer in a letter dated September 8, 2008. This letter explains that <br />one cultural resources site has been recorded in the PR-14 project area which has been <br />recommended as not eligible for listing in the National Register of Historic Places, but adverse <br />effects to this site should be avoided until the site can be reevalauated and officially determined <br />if it is eligible for listing. A copy of the letter was forwarded to MCC. <br />5
