not be needed. Stipulation #7 requires MCC to complete a geotechnical <br />investigation prior to constructing the Upper Refuse Disposal Area. <br />F. Impoundments <br />Refer to the section regarding sediment ponds (4.05.9). <br />G. Surface and Ground Water Monitoring <br />The applicant will conduct monitoring of ground water in a manner approved <br />by the Division. The ground water monitoring plan is specified in Table 5, <br />Section 2.04.7 and in Exhibit 71. Point-of-compliance monitoring wells are <br />located near the permit boundary at the approximate down-gradient extent of <br />the B and E-seams. Areas mined in the F-seam are up-gradient from the <br />outcrop, resulting in down-gradient flow in the F-seam not leaving the permit <br />area. Colluvium is monitored between the refuse piles and the river, and data <br />on down-gradient alluvial water is available to the Division from the up- <br />gradient alluvial well at the Bear III mine, adjacent to the West Elk Mine on <br />the west, immediately down-gradient from the West Elk operation (4.05.13(1)). <br />2. The applicant will conduct monitoring of surface water in a manner approved <br />by the Division. The surface water monitoring plan is specified in Table 5, <br />Section 2.04.7 and in Exhibit 71. (4.05.13(2)). <br />H. Transfer of Wells <br />No transfer of wells is proposed at this time. All monitoring wells will be <br />reclaimed prior to bond release [4.05.14 (3)]. <br />1. Discharge of Water into an Underground Mine <br />1. There will be no discharge of water into an underground mine [4.05.16(2)]. <br />Stream Buffer Zones <br />The Division previously approved underground mining activities within <br />100 feet of the North Fork of the Gunnison River, which is a perennial stream <br />with a biological community. This decision was based on a finding that the <br />original stream channel will not be disturbed, water quality and quantity shall <br />not be adversely affected, and appropriate riparian vegetation will be <br />reestablished. The buffer zone variance was granted for the water intake <br />gallery, sediment pond and associated spillways and ditches, a railroad siding, <br />the railroad loadout facility, a light-use road and a portion of the old Bear No. <br />1 and 2 Mines site. These facilities are located on the north and south banks <br />of the North Fork of the Gunnison River. Figure 12 in the MCC permit shows <br />the disturbed areas within the buffer zone. The Division approved this <br />variance on August 6, 1981, according to Rule 4.05.18(1). This variance was <br />26
