Sherman <br />Executive Director <br />Dick Wolfe, P.E. <br />Director <br />RECEIVED <br />OCT 15 Z008 <br />Division of Reciamavori, <br />Mining and Safety <br />Your letter dated September 9, 2008, requesting renewal of the above referenced substitute <br />water supply plan to cover depletions caused by an existing gravel mining operation has been <br />reviewed. The required fee of $257 for the renewal of this substitute water supply plan has been <br />submitted. The original plan was approved on March 26, 1993 and was most recently renewed on <br />January 14, 2008. As indicated in the previous approval letter, Connell Resources, Inc. has begun <br />the process of backfilling this site above the groundwater table to remove the long-term <br />augmentation requirement. In a letter dated April 23, 2003, the State Engineer's Office allowed the <br />site to be operated under a substitute water supply plan until such time that the pit has been <br />completely backfilled. Connell Resources, Inc. has amended their DMG permit to reflect that the <br />groundwater pond will be backfilled completely. According to the information provided, backfilling of <br />the site restarted again in August 2008. Note that all ground water at this site was exposed after <br />December 31, 1980. <br />Please note that the approval of this substitute water supply plan does not relieve the <br />Applicant and/or the landowner of the requirement to obtain a water court decree approving <br />a permanent plan for augmentation or mitigation to ensure the permanent replacement of all <br />depletions, including long-term evaporation losses and lagged depletions after gravel mining <br />has ceased. In the previous plan we indicated that renewal of this plan is contingent on the <br />Applicant demonstrating that the backfilling of the site has continued or contingent upon the <br />Applicant filing an application for a plan for augmentation with the Division 1 Water Court by <br />October 31, 2008 that includes, long-term evaporation losses at the G. L. Pit site. Based on <br />the information provided it was determined that the Applicant has satisfied the above <br />requirement. <br />The only consumptive use associated with the G.L. pit site will be from evaporation of <br />exposed groundwater. The current exposed surface area at the G.L. Pit remains at 6.4 acres. Total <br />estimated annual consumptive use for this plan is 9.8 acre-feet of evaporation from 6.4 acres of <br />exposed water surface area of which 5.5 acres have a phreatophyte credit. For the 5.5 acres an <br />evaporative value of 16.76 inches was used. The evaporative depletions from the 5.5 acres are 7.7 <br />acre-feet. The remaining 0.9 acres of the total 6.4 acres exposed at the site create an evaporative <br />depletion without phreatophyte credit.
