<br />TFIIS MODIFIED COAL LEASE is entered into on JAN 0 5 2001 by and between the UNITBD STATES OF
<br />AMERICA, hereinafter called the Lessor, through dte Bureau of Land Management. and

<br />This modified lease shall retain the effecflve date June 1> 1982, of the orignal COAL Ll:acr-. C-8424, and is effective for a period of
<br />20 years ffierefrom, and for so long thereafter az coal is produced in commercial quantities from the [eased lands, subject to
<br />readjustment of laesa terms at the end of the 20th lease year (ltltte 1, 2002), and each 10-year period thcreeftet.
<br />Sec. 1. This lease is issued pursunnt aad subject to the terms and provisions of the Mineral Lands Leasing Act of 1920, az amended,
<br />41 Stat. 437, 30 U.S.C. 181-287, hereinafter refereed to az the Act; and to the regulations end formal orders of the Secretary of the Ittfetior
<br />which are nnw or hereafter in force, when not inconsistent with the express and specific provisions herein.
<br />• Sec. 2. Lessee az the holder of Coal Lease G8424, issued effective Tune 1, 1982, was granted the exclusive right and privilege to drill
<br />for, mine, extract, remove or otherwise process end dispose of the coat deposits in, upon, ar under the lands described below az
<br />Tract 1.
<br />The lxssor in consideration of fair market value, ranks and royalties to be paid, end the conditions and covenants to be observed as
<br />herein set forth, hereby grants and leases to lessee the exclusive righ[ and privilege to drill for, mine, extract, remove, or otherwise
<br />process and dispose of the coal deposits in the lands described below as Tract 2.
