Page 35 <br />Construction Materials Rule 1 <br />(4) Applications for amendments shall be reviewed by the Board or <br />Office in the same manner as applications for new Permits. <br />(5) All aspects of the mining operation and Reclamation Plan that are <br />subject to the amendment will be subject to these Rules, as <br />amended, in effect at the time the Permit is amended. <br />1.10.2 111 Special Operation Permit Amendments <br />111 Special Operation permit amendments are not allowed by statute. An <br />Operator may only make changes defined under Rule 1.1(49). <br />110(5) 1.11 CONVERSIONS <br />1.11.1 Purposes and Types <br />(1) A conversion is an application to change an existing permit to another type <br />of permit such as changing a 110 Limited Impact Permit to a 112 <br />Reclamation Permit. <br />(2) Unless such mining is incidental to the permitted activity, any Operator who <br />intends to mine any commodity other than a "construction material" <br />commodity, as defined in Section 34-32.5-103(3), C.R.S., shall apply for a <br />conversion to a new permit under the provisions of Section 34-32-101, et <br />sec, C.R.S. Upon issuance of the new permit, the existing permit under <br />Section 34-32.5-101, et seMc, C.R.S., shall be terminated. Such <br />determinations may be made through declaratory order by the Board. <br />1.11.2 Application Process <br />(1) Except for permit conversions under Subparagraph 1.11.1(2), the original <br />Permittee cannot convert a Permit unless the permit has been in existence <br />for two consecutive years. <br />(2) All fee, warranty and processing requirements shall apply as though the <br />Conversion application were a new permit application.
