and precipitant created a higher COD than normal, resulting in low DO levels during the <br />initial discharge from the treatment plant. <br />Mine water has not been treated and discharged at the Whirlwind Mine between the July <br />2008 discharge event and September 2, 2008 (i.e. there was no discharge in August). The <br />September discharge event is currently ongoing and is expected to continue until <br />September 5, 2008. DO levels are being monitored throughout this discharge event and a <br />COD sample was collected on September 3 for analysis. A confirmatory WET test will <br />be conducted on samples collected on September 3 to 5. This WET test will also be used <br />to satisfy the quarterly WET test requirement set forth in the permit. <br />Energy Fuels will provide the WQCD with additional status reports due on the following <br />schedule: <br />90-day status report October 6, 2008 <br />120-day final report November 5, 2008 <br />The above schedule is dictated by the water discharge permit. At this point in time, Energy <br />Fuels believes that the confirmation WET test will pass.
