Please find the attached July and August 2008 Discharge Monitoring Reports (DMR's)
and Preliminary Toxicity Investigation 60-day Status Report for the Whirlwind Mine in
Mesa County.

The DMR's are required to be submitted under Colorado Discharge Permit System
(CDPS) Permit Number CO-0047562. Note that there was one exceedance of the
effluent limitations during the July 28 to 31, 2008 treatment and discharge event for
selenium. I've included the non-compliance notification letter Energy Fuels provided to
the Colorado Department of Public Health and Environment as well as the laboratory
data for the sampling event that took place on July 29, 2008.
Energy Fuels is currently researching and consulting with a mine water treatment
specialist (Mark Reinsel, Ph.D., P.E.) to explore additional possible treatment solutions to
the selenium levels being observed in the mine water. Bench scale testing with increased
dosages of sodium bisulfite was conducted and indicated that the sodium bisulfite was
ineffective in reducing selenate to selenite. Further bench scale testing with sodium
bisulfite and ion exchange columns is being conducted to determine the effectiveness of
these treatment methods.
Attached with this letter is the third party sampling event analytical results from the July
29, 2008 sampling event. The sampling was performed by Western Water & Land, Inc.
(WWL) and the analyses by ACZ Laboratories. These analytical results are very
consistent with the analytical results for the samples collected by Energy Fuels and
analyzed by Energy Laboratories.
