Note that there was one exceedance of the <br />effluent limitations during the July 28 to 31, 2008 treatment and discharge event for <br />selenium. I've included the non-compliance notification letter Energy Fuels provided to <br />the Colorado Department of Public Health and Environment as well as the laboratory <br />data for the sampling event that took place on July 29, 2008. <br />Energy Fuels is currently researching and consulting with a mine water treatment <br />specialist (Mark Reinsel, Ph.D., P.E.) to explore additional possible treatment solutions to <br />the selenium levels being observed in the mine water. Bench scale testing with increased <br />dosages of sodium bisulfite was conducted and indicated that the sodium bisulfite was <br />ineffective in reducing selenate to selenite. Further bench scale testing with sodium <br />bisulfite and ion exchange columns is being conducted to determine the effectiveness of <br />these treatment methods. <br />Attached with this letter is the third party sampling event analytical results from the July <br />29, 2008 sampling event. The sampling was performed by Western Water & Land, Inc. <br />(WWL) and the analyses by ACZ Laboratories.
