III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection. The inspection was conducted in the afternoon after work hours so there was no activity <br /> on site. <br /> Roads <br /> The paved main haul road was in good condition. The guard rail was in place. There were no indications of coal <br /> fines on the main highway. The graveled east entrance road was in good condition as well.The east gate was <br /> open. The light use dirt road that runs between the facilities bench and the railroad tracks was dry and passable. <br /> Signs and Markers <br /> The mine ID signs were up at the main entrance,east gate entrance and along the east side road near the railroad <br /> tracks. The information on the signs was correct. <br /> Facilities <br /> There were four moderately sized stockpiles of coal and coal fines on the facilities bench.No fugitive dust <br /> problems were observed with the stockpiled coal. Several railcars filled with coal were on site but,again, <br /> fugitive dust was not a problem.No problems were observed at the loadout office,substation,material storage <br /> area and the unloading and loading structures.The containment berm was up at the fuel facility. There were no <br /> fuel leaks. <br /> Hydrology <br /> The east side sediment pond was completely dry.The pond embankment was well vegetated and pond inslopes <br /> and outslopes were stable. The gate on the primary discharge pipe was in the closed position.The emergency <br /> spillway was well grassed.The west side dugout pond was completely dry as well. The single open channel <br /> discharge spillway was clear of obstructions. <br /> Culverts and ditches were operational with no problems noted.The straw bales and silt fence along the railroad <br /> track small area exemption were in place. <br /> Topsoil <br /> The east side topsoil stockpile had a moderate vegetative cover, although the vegetation is now brown in color. <br /> The same is true of the west side topsoil stockpile, although the vegetative cover is good. Topsoil signs were up <br /> on both topsoil stockpiles. <br /> c:/word/terror/insp0908 <br />
