III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> There was only a little water in pond F.The pond had been cleaned out earlier in the year. The pump,discharge <br /> hose and float that serve as the primary discharge structure was in place,as was the pond's emergency spillway. <br /> The collection ditches leading into pond F had sufficient capacity.The topsoil stockpiles below the gob pile area <br /> were well vegetated. Topsoil stockpile signs were up. The coverfill stockpile on the extreme east end of the gob <br /> pile area had moderate vegetative growth. Surface disturbance markers were up around the mine site. <br /> The operator has started the earthwork construction associated with gob pile no. 3,which is located in a field <br /> west of the unit train loadout topsoil stockpile.The collection ditch at the base of the construction site that leads <br /> to pond J was in place,as were the silt fence and surface disturbance markers.The operator has removed topsoil <br /> from the entire gob pile no.3 site and has stockpiled it at the unit train loadout topsoil stockpile. The operator <br /> was removing subsoil in order to establish a level base on the west end of the gob pile site. The operator plans to <br /> develop gob pile no. 3 in three stages,with the western third of the site developed first,then proceeding to the <br /> east with the middle third and, finally,finishing up with the eastern third of the site. <br /> Unit Train Loadout <br /> A fully loaded unit train was at the loadout and pulled out during the inspection. There were no indications of <br /> offsite fugitive dust problems. The sediment control system was in place at the loadout.Culverts and ditches <br /> were functional. There was no water in either pond J or pond K.Pond spillways were functioning properly. <br /> Pond embankments were stable.Ditches leading into the two ponds had sufficient capacity. The train spur bench <br /> outslope was well vegetated and showed no signs of slope instability. At the western end of the spur bench,a <br /> trickle of water was flowing from one of the underdrains and a similar flow through one of the railroad culverts. <br /> The mine ID sign was up at the entrance and surface disturbance markers were up around the site. <br /> Hubbard Creek Area <br /> The operator is constructing roads and pads for thirteen gob vent boreholes.At the head of Dove Gulch,the <br /> light use road was being constructed on a steep hillside.At the bottom of Dove Gulch,a road had already been <br /> constructed and the drill pad was in the process of being constructed. The mud pit had already been dug and a <br /> fence had been put around it. Topsoil was salvaged and marked appropriately. <br /> The Bruce Park Dam and Terror Creek Reservoir <br /> Since this dam and reservoir are the subject of Permit Revision Nos. 10 and 11, a site visit was made.There was <br /> only a small volume of water left in the reservoir since it is nearing the end of irrigation season. Piezometers are <br /> located on the earthen dam and are monitored.On the north side of the reservoir is a landslide area.Piezometers <br /> are also in position on the landslide mass. The saddle dam on the other side of the reservoir was also visited. <br /> Records <br /> The mine records were at the mine office and were in compliance.Please refer to the attached records checklist. <br /> c:/word/bowie2/insp0908 <br /> 2 <br />
