III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection. <br /> Roads <br /> The mine access road across Hubbard Creek was dry and passable.The mine site entrance gate was closed and <br /> locked.The light use road leading to pond 5 was also dry and passable. The county road up the Hubbard Creek <br /> canyon that leads to the mine site was in good condition. <br /> Hydrology <br /> Pond 4 was completely dry. The pond 4 embankment was well vegetated and appeared to be stable. The pond 4 <br /> discharge pipes were functional. The road culvert that brings runoff from the reclaimed coal stockpile area to <br /> pond 4 was clear.The upland diversion ditch at the reclaimed coal stockpile area was well vegetated and had <br /> enough capacity. <br /> Pond 5 was also dry. The pond 5 embankment was stable and had a good vegetative cover. Pond 5 spillways <br /> were operational.The collection ditch that leads to the north end of pond 5 was well grassed and had sufficient <br /> capacity. <br /> There was no water coming out of the central and south underdrains. A steady flow of drips was coming out of <br /> the northern underdrain. The black plastic 18 inch diameter culvert was in place. <br /> Noxious Weeds <br /> The knapweed adjacent to pond 4 was sprayed,according to the operator, but the plants had not shown any sign <br /> of distress at the time of the field inspection. <br /> Signs and Markers <br /> The mine ID sign and the"records location"sign were both on the mine entrance gate. The required information <br /> was on the mine Id sign. Surface disturbance markers were up around the disturbed area. <br /> Reclamation <br /> The reclaimed mine slopes appeared to be stable.No erosional gullies were observed, nor were there any <br /> indications of slope instability. Bench terraces had positive drainage. There was a good vegetative cover over <br /> the reclaimed slopes.No seeps were visible on the slopes. <br /> c:/word/b 1 ueri bbon/insp0908 <br />
