Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Foidel Creek Mine, C-82-056, Third Quarter 2008 Coal Waste Pile Inspection Report <br />Dear Mr. Nettleton: <br />The Division received Twentymile Coal Company's (TCC) Third Quarter 2008 Coal Waste Pile <br />Inspection Report on October 6, 2008 via e-mail. The report was prepared by North West Colorado <br />Consultants for Twentymile Coal Company. Compaction tests were conducted on July 3, 2008 at <br />locations 380, 381, 382 and 383in Areas 2 '/2 and 3 of the refuse disposal area (RDA). A second test <br />during the third quarter 2008 was conducted on July 29, 2008 at location 384, 385 and 386 in the <br />south part of Area 3 of the RDA. Compaction testing was also conducted on August 12, 2008 at <br />locations 387, 388, 389, and 390 in areas 2 '/2 and 3 of the RDA. A fourth compaction test was <br />conducted during the third quarter at locations 391, 392, 393, 394 and 395 in Areas 2 and 3 I/z at the <br />RDA. No problems were noted in the engineer's report with regard to the construction, grading, <br />drainage, or operation of the pile. The Engineer visited the site on September 26, 2008. <br />North West Colorado Consultants, Inc. conducted the inspection and provided their results to TCC. <br />Results of monitoring of 5 piezometers was included in the report. The report implies that piezometer <br />5MW casing has been repaired since the previous quarter inspection. TCC provided no explanation <br />regarding the previously reported damage to this well. Please provide to the Division an explanation <br />of the previous damage to piezometer 5MW.
