Cattany <br />Division Director <br /> Natural Resource Trustee <br />Re: Marr Mine, Permit No. C-80-006, 2008-2009 Insurance Certificate <br />Mr. Patterson: <br />Energy Fuels Coal, Inc. submitted a copy of proof of insurance certificate for the Marr Mine (C-80- <br />006) on October 2, 2008. The insurance certificate covers the time period from October 1, 2008 <br />through September 30, 2009. The certificate lists the insured as Energy Fuels Corporation. However, <br />the Marr Mine permit lists the permittee as Kerr Coal Company with the sole parent company as <br />Energy Fuels Coal, Inc. Please correct the certificate to reflect the insured party as either Kerr Coal <br />Company or the parent company of Energy Fuels Coal, Inc. <br />Due to the Division's name change, on August 9, 2006, to the Colorado Division of Reclamation, <br />Mining and Safety, please correct the certificate holder as the Colorado Division of Reclamation, <br />Mining and Safety. <br />It is noted that the description of operations includes the Raton Creek Mine (C1982-055). Raton <br />Creek Mine permit has been terminated and the Division no longer requires the operator to carry <br />insurance for the Raton Creek Mine. <br />Submittal of an insurance certificate with these corrections will bring the insurance documentation in <br />compliance with Rule 2.03.9. <br />Sincerely, <br />i <br />CJanet .
