Cattany <br />Division Director <br />Natural Resource Trustee <br />In previous correspondence from the Division, dated July 11, 2008 and August 4, 2008, the Division <br />informed you of filing deficiencies for the above referenced application. The Division has received <br />responses to our correspondences. However, the responses have not provided the requested and <br />necessary information and the submittal remains incomplete for the purposes of filing. <br />Herein, all references to the Act and Rules refer to the Colorado Land Reclamation Act for the Extraction <br />of Construction Materials, 34-32.5-101 et seg., C.R.S. (the Act), and to the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for the Extraction of Construction Materials <br />(the Rules). Copy of the current Act and Rules, as well as application forms, are available on the <br />Division's web site at www.mininq.state.co.us. <br />As noted in the Division's previous correspondences, pursuant to Rule 1.4.1(6), in addition to submitting <br />an appropriately completed permit application form, the Applicant shall submit all applicable Exhibits <br />specified in Rule 6 for the appropriate type of operation. Since the permit application is for a Limited <br />Impact 110 type permit, pursuant to Rule 6.1.2, the application shall provide all the Exhibits, as described <br />in Rule 6.3. These Exhibits must conform to the general requirements of Rule 6.2 and demonstrate <br />compliance with the performance standards of Rule 3.1. A detailed clarification of the requirements of <br />Rule 6.3 follows: <br />Exhibit A - Legal Description and Location Map <br />Pursuant to Rule 6.3.1(1), Exhibit A of the application must identify the affected land and specify the <br />affected areas, which, according to page one of the application form is 1.5 acres. However, Exhibit A of <br />the application describes an 84.25 acre area. Please revise Exhibit A to describe the proposed 1.5 acre <br />permit area. <br />Pursuant to Rule 6.3.1(3), Exhibit A of the application must include a location map, showing the affected <br />land and existing and proposed roads or access routes to be used in connection with the mining <br />operation. Names of all immediately adjacent surface owners of record shall also be shown. The <br />operation location map shall be a standard 1:24,000 scale USGS map. The location of the proposed <br />operation shall be shown and labeled with the mine site name. <br />However, the location map provided with the application is of 1:12,000 scale and is not a 7.5 minute <br />USGS quadrangle. Additionally, the submitted map shows the same 84.25 acre parcel of land described <br />in the above referenced legal description and not the 1.5 acre permit area.
