By early <br />2009 it is expected the Hubbard Creek Fan will be shut down and an additional new fansite will <br />need to be constructed along Bear Creek. This fansite, referred to as the Bear Creek fansite, <br />consists of a fan, ducting, pre-engineered fan structure and enclosure, motor and controls (all <br />formerly used and moved from the Sanborn Creek Mine) and located on a concrete slab <br />foundation. Development material from excavation of the facility pad will form the approximate <br />2.3 acre pad/facility area. The material from the 16' diameter x 620' raise bore steel plate lined <br />shaft will be stored in the mine workings. Topsoil recovered from the disturbance area will be <br />stockpiled south of the fansite pad. The ephemeral Bear Creek is to be placed in a 450' x 6' <br />CMP culvert (see attached ACOE NWP-50 SPK-2008-1035 CW for placement in Exhibit 2.03- <br />E4, Other Permits for additional details). The substation is to be installed on concrete ties, and <br />fed by a new 46 KV power line spur from the existing line that feeds the Hubbard Creek <br />facilities. The pad could also contain up to 3 - 6" x 620' cased utility boreholes and will be <br />protected with portable chainlink fencing to reduce vandalism from travelers on the adjacent <br />"public" Bear Creek two track ranch road. Sediment control for the small area will be handled as <br />a small area exemption using such alternate sediment control techniques of sediment traps, straw <br />bales, and waddles, silt fence, rock protection, vegetation filters, etc. <br />The approximate 2.3 acre facility lies entirely on Oxbow fee surface and minerals and is located <br />in Gunnison County. <br />• Page 1
