At your request, I have reviewed the 28-Aug-2008 submittal from J. E. Stover &
Associates, Inc., which was prepared in response to the Division's Preliminary Adequacy
Review for TR-55. Each of the items listed in the PAR has been adequately addressed by
the current submittal.
Additionally, the operator provided me with the Geotechnical Investigation report for the
site, prepared for Bowie Resources, LLC by Yeh and Associates, Inc. and dated 24-Jul-
2008. The geotechnical designs presented with TR-55 incorporate fully the
Recommended Mitigation features of the Yeh investigation.

Plan View
1.) The French drain pipe crosses beneath the reconstructed road, and then follows
the slope as it drops to the B-Seam Portal bench. No mention is made of the
amount of flow anticipated from the French drain. Neither has any information
been provided regarding where the flow goes, once it reaches the bench below.
Please provide the Division with an estimate of the amount of flow anticipated to
emanate from the French drain system, and a description of how the flow is
handled, once it reaches the B-Seam Portal Bench.

2.) The cover letter for the TR-55 application (dated 09 July 2008) makes reference
to approximately 8,000 cubic yard of cut and fill activity which will occur on the
slope face. Typical Section D (Map 5-16) provides a cross sectional view, but the
cut and fill area is not clearly delineated in the Plan View (although it can be
inferred by the form of the contour lines). Nor is the B-Seam Portal Bench
identified in the plan view.
