6N -02- o <br />C- Ao -off Loy <br />e.,,,??o W <br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to <br />approve with conditions Permit Renewal Application No. 2 (RN-2), sub- <br />mitted by New Elk Coal Company, LLC for a coal mining permit at the <br />Lorencito Canyon Mine (Permit No. C-1996-084). The proposed renewal <br />will allow for continued reclamation operations at the site. No additional <br />mining operations are proposed for approval under this renewal. <br />The Lorencito Canyon Mine is located in Las Animas County, approxi- <br />mately 3 miles west of Segundo on Hwy 12, Colorado. Coal interest at <br />this Surface mine is Private, and the surface to be affected is Private <br />land. The permit area encompasses approximately 3,142.00 acres. <br />This proposed decision is based on a finding that the proposed opera- <br />tion will comply with all requirements of the Colorado Surface Coal Min- <br />ing Reclamation Act, Section 34-33-101 et seq., C.R.S., and the regula- <br />tions promulgated thereunder. <br />A copy of the "Proposed Decision and Findings of Compliance", includ- <br />ing any stipulations, is on file for public inspection at the Colorado Divi- <br />sion of Reclamation, Mining and Safety, Room 215 Centennial Building, <br />1313 Sherman Street, Denver, Colorado 80203, and at the Las Animas <br />County Clerk's Office, 200 East First Street, Room 104, Trinidad, CO <br />81082. Persons with an interest that may be adversely affected by the <br />proposed decision may request a formal hearing before the Mined Land <br />Reclamation Board on the proposed decision.
