III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) on 24 September 2008. The weather was clear and the <br /> mine site was dry during the on-the-ground inspection of the site. Scott Wanstedt of BME <br /> accompanied the inspection. This inspection focused on the areas approved through MR-133, MR- <br /> 134, MR-135, MR-136, and MR-137. <br /> The mine is currently operating as permitted. Deserado has moved the longwall to panel 9 and it <br /> appears that October will be the timeframe for Deserado to be back at full production. No drilling <br /> activities were being conducted during the on-site inspection. <br /> Roads <br /> The paved Deserado Mine Road appeared to be well maintained and in good condition. The haul <br /> road from the facilities area to the proposed Vent Shaft#3 road appeared to be stable and displayed <br /> good drainage with no problems noted. <br /> Hydrologic Balance <br /> The temporary riser at DP-1 continues to be in place and will be replaced at the conclusion of the final <br /> design per BME's permit. BME will submit a MR to address the completed riser pipe design. The <br /> temporary riser appeared to be in compliance with no problems noted. <br /> General Mine Plan Compliance <br /> The location and position of Return Shaft 4 was inspected and found to be located and sized <br /> according to the permit. The pad construction was in process with no problems noted. Site LWB10-1 <br /> was in the process of being drilled at the time of the inspection; drill rig was on site although drilling <br /> was not active during the inspection no problems were noted. N7-53 was completed as permitted with <br /> no problems noted during the inspection. Proposed nitrogen injection holes N8-36 and N8-21 <br /> locations were observed and were located as permitted. Vent Shaft#3 location and road was <br /> inspected and was in the approved location during the inspection. Survey stakes delineated the <br /> locations of the approved Vent shaft and road. <br /> All locations inspected were located using Trimble GeoXT GPS unit and transferred into ArcGIS to <br /> determine locations of approved sites. <br /> Overall, the Deserado Mine is in good condition and appears to be conducting operations as required. <br />
