III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> fads or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. Ron Thompson of Peak Project Management (representing the operator) accompanied <br /> the inspection. The weather was hot and dry. The mine is a reclaimed underground mine. New Elk <br /> Coal Company had previously applied for phase 11 bond release on the majority of the permit area. The <br /> Division made a proposed decision to approve the bond release on August 26. 2008. The decision will <br /> become final if no objections are received by the end of the public comment period. The NW vent fan <br /> was not included in the bond release application. The inspection did not look at the areas approved for <br /> final bond release, only at the remaining NW vent fan area and its access. <br /> Roads: The access road to the reclaimed vent fan site has been reclaimed to the junction with a gas road. <br /> The gas road is well maintained by a third party and is regularly used. Cover on the reclaimed access <br /> road was stable and in good condition. No erosional features were apparent on the reclaimed road area. <br /> Reveeetatiow Vegetation establishment on the reclaimed pad area is in good condition and appears <br /> diverse and healthy. One Russian knapweed plant was observed near the southwest side of the pad. The <br /> plant and roots were dug up with a shovel before we left the site. Plant material was removed to reduce <br /> the spread by seed. The site should continue to be monitored for re-emergence of knapweed. <br /> Reclamation Success: This site appears stable with no erosional features forming. Vegetation is well <br /> established. Other than monitoring for weeds, no problems were identified on the reclaimed vent fan <br /> area. <br /> Golden Eagle NW vent shaft pad <br /> 3 of 4 WHITE-File YELLOW-Operator PINK-Specialist <br />
