ORIGINAL - PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-9n07-031 <br />INSPECTION DATE: 2198108 <br />INSPECTORS INITIALS: R- <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to make sure <br />the operator did not affect lands outside of his permit are which is the same as the <br />affected area on 9/28/08. While on site on another inspection the Division dropped by the <br />operation with Mr. Jeff Fugate of the AG"S office ON 9/26/08. Mr. Scott was on site <br />pumping the water from the large pond to lower the volume and also doing some maintenance <br />work. Along the west side of the maximum extent of the permit and affected area, the <br />Division noted that it was close to the fence line and pointed to Mr. Scott not to exceed <br />the affected area boundary. He stated that under placer operation if material falls to his <br />side during the excavation process, from areas outside his permit he was allowed to keep <br />it. He was informed be that as it may under the 1872 mining act for placer operation, as <br />far as the Division was concerned, if the operator affects areas outside the permit, he <br />will be in violation of CRS 34-32-124. <br />He agreed not to affect areas outside of his permit limitation and informed the Division <br />that he will be processing over the weekend, because he had found a rich ore zone. The <br />Division wanted to make sure the rich zone discovered did not include areas outside of the <br />permit. Also wanted to make sure, since the large pond and fresh water ponds did not have <br />much of free board, the Division wanted to verify, given the rain storms the area was <br />getting each afternoon, no discharge was taking place from the settling pond. <br />Site was active at the time of the inspection. The rotary sluicer was operating, and <br />mining along the western portion of the permit area was continuing. Mr. foster,a front end <br />loader operator his daughter and a mechanic were on site. Mr. Foster was notified again <br />that he will not be allowed to affect areas outside the permit. The western end of the <br />permit area as noted on Friday had reached the permit limit. A portion of the fence was <br />dangling due to the removal of the material below it. The permit boundary marker which is <br />about a foot from the fence line was still in place. The Division again emphasized the <br />need not to exceed the permit boundary marker. Mr. Foster agreed he will not exceed the <br />boundary marker for the areas and also stated that the rich ore he found was a good <br />distance from the western edge of the permit area. <br />No mining outside of the permit area was noted at the time of the inspection. Ponds were <br />as noted on Friday, 9/26/08, with very little free board.
