Box 1470 <br />110 E. 3rd Street, suite 201 <br />Rifle, CO 81650 <br />Dear Mr. Day: <br />September 17, 2008 <br />Our staff has reviewed your request for the Notice of Intent (NOI) to Conduct Prospecting Operations <br />located on American Shale Oil, LLC `s (AMSO) Oil Shale Research, Development and Demonstration <br />(R,D&D) Lease COC-69169. The proposed action is within the scope of CO-110-06-118-EA, "EGL <br />Resources, Inc. Oil Shale Resear velopment And Demonstration (R,D&D) Tract" Environmental <br />Assessment, and is therefor, approved. <br />Construction of Test Pad and H ad maybe in phases to prevent unnecessary surface disturbance until <br />additional wells on the pad are required. For phased construction of these two pads that occurs <br />Februaryl through August 15 the second bullet "Minimize, where possible vegetation clearing while <br />migratory birds are nesting (Februaryl through August 15);" of Special Stipulation 5 is excepted. All <br />other applicable lease terms, conditions, and stipulations apply. A follow-up raptor survey completed <br />during the 2008 breeding season will be adequate through the 2009 breeding. Prior to any surface disturbing activity a bond in <br />the amount determined by CDRMS is required to be filed with and payable to the Department of the
