This <br />document contains various changes from the original Plan of Operations (POO) in the nomination that <br />was submitted to the WRFO on September 14, 2005. The POO was evaluated during the approval <br />process for E. Q L.'s RD&D lease tract application. The WRFO reviewed the ISDP to determine its <br />compliance with the lease terms. Importantly, a compliance determination with Section 2 of the lease <br />and with the Environmental Assessment for the lease tract also was performed. Section 2 states, <br />"...process and disposal of the oil shale and the products of oil shale contained within the Leased Lands <br />as proposed in the nomination submitted in response to the Federal Register notice of June 9, 2005.". <br />Subsequently, additional clarifications and discussion between WRFO and E.G L. have occurred. <br />After further review of the ISDP, and after the discussion held on July 2, 2008 and July 21, 2008 <br />between WRFO and E.G.L, WRFO has determined that the submitted ISDP is premature, lacking <br />adequate details sufficient for a Plan of Development, and that the submitted IDSP is more appropriately <br />an addendum to the POO. Site specific research and development work has led to the proposed changes <br />from the original POO. The proposed changes do not, in WRFO's estimation, constitute a change in the <br />--process of recovery of shale oil -as submitted in the origin arproposal: If you concur with WRFO's <br />evaluation, please resubmit your IDSP as a dated addendum to the POO.
