This
document contains various changes from the original Plan of Operations (POO) in the nomination that
was submitted to the WRFO on September 14, 2005. The POO was evaluated during the approval
process for E. Q L.'s RD&D lease tract application. The WRFO reviewed the ISDP to determine its
compliance with the lease terms. Importantly, a compliance determination with Section 2 of the lease
and with the Environmental Assessment for the lease tract also was performed. Section 2 states,
"...process and disposal of the oil shale and the products of oil shale contained within the Leased Lands
as proposed in the nomination submitted in response to the Federal Register notice of June 9, 2005.".
Subsequently, additional clarifications and discussion between WRFO and E.G L. have occurred.
After further review of the ISDP, and after the discussion held on July 2, 2008 and July 21, 2008
between WRFO and E.G.L, WRFO has determined that the submitted ISDP is premature, lacking
adequate details sufficient for a Plan of Development, and that the submitted IDSP is more appropriately
an addendum to the POO. Site specific research and development work has led to the proposed changes
from the original POO. The proposed changes do not, in WRFO's estimation, constitute a change in the
--process of recovery of shale oil -as submitted in the origin arproposal: If you concur with WRFO's
evaluation, please resubmit your IDSP as a dated addendum to the POO. Please note that submission of
the above referenced addendum does not affect the recently submitted plan for data collection which
currently is being processed by WRFO stair
If there are any questions, please contact Paul Daggett, Mining Engineer at (970) 878-3819.
Sincerely,
K nt E.
4?alte
Field Mager
July 28, 2008
