I?w ur ;c2008 ion, <br />Response to DBMS Second Notice of Deficiency Kning and Safety <br />Dear Mr. Marshall: <br />American Shale Oil, LLC (HMSO) is submitting this response to the Colorado Division of <br />Reclamation, Mining and Safety (DRMS) Second Notice of Deficiency dated September 22, 2008, for <br />AMSO's Phase I NOI No. P-2008-046 application. Each issue identified in the DRMS Second Notice <br />of Deficiency is presented in italics below followed by AMSO's response to the deficiency. <br />1. In Section 2.0 SURFACE WATER, on page 2, there is a typographical error or omission, <br />"The sites will be marked in the field, and the Global Positioning System (GPS) location of <br />each site will be recorded. " Please correct the sentence to state what the sites will be marked <br />with. <br />AMSO Response: <br />The referenced sentence in the AMSO Sampling and Analysis Plan for Surface-Water and <br />Groundwater Monitoring has been corrected to read; "The sites will be marked in the field <br />with a wooden stake and tag denoting sample ID, and the Global Positioning System (GPS) <br />location of each site will be recorded in a bound field notebook." <br />2. If micro purging sampling is to be performed on wells without the use of dedicated pumps, <br />what will be the time interval between pump installation and sampling? <br />AMSO Response: <br />The following text has been added to Section 3.3.2 (Groundwater Sampling) of the AMSP <br />Sampling and Analysis Plan for Surface-Water and Groundwater Monitoring: <br />"If a portable micro purging pump is used to collect samples, the following additional <br />procedures will be implemented:
